By accessing our platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

Agreement to Terms

By accessing or using the DissolvdRX platform, website, or any related services (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access or use our Services. These Terms apply to all visitors, users, and others who access the Services.

Eligibility

You must be at least 18 years of age to use our Services. By using our Services, you represent and warrant that you are at least 18 years old, have the legal capacity to enter into these Terms, and are not prohibited from receiving the Services under applicable law. Service availability varies by state — not all treatments are available in all U.S. states.

Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our platform and updating the “Last Updated” date. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.

Nature of Services & Medical Disclaimer

Telehealth Platform — Not a Medical Provider

DissolvdRX is a telehealth technology platform that connects patients with independent, licensed healthcare providers. DissolvdRX is not itself a medical provider, physician group, or pharmacy. All clinical services, medical evaluations, and prescription decisions are made solely by Beluga Health, a licensed telehealth medical group, and its affiliated providers. All prescription medications are dispensed by independent, state-licensed U.S. pharmacies.

No Doctor-Patient Relationship with DissolvdRX

Your use of the DissolvdRX platform does not create a doctor-patient relationship between you and DissolvdRX LLC. Any doctor-patient relationship that may arise is exclusively between you and the independent licensed healthcare provider who reviews your intake and provides care.

No Guarantee of Prescription

Completing our online intake form and paying for a consultation does not guarantee that a prescription will be issued. Prescriptions are issued solely at the discretion of the reviewing licensed healthcare provider based on their independent clinical judgment. If a prescription is not approved, you will be notified and a refund will be issued per our Refund Policy.

Privacy Compliance

DissolvdRX is committed to complying with all applicable federal and state privacy laws governing the handling of personal health information. We implement administrative, physical, and technical safeguards to protect the confidentiality, integrity, and availability of your personal health information.

Data Collection & Use

We collect personal and health information necessary to facilitate your care and operate our platform. This includes information you provide during registration, health intake, and ongoing use of the Services. We do not sell your personal information. Your health information is shared only with your treating provider and dispensing pharmacy as necessary for your care, and with data-secure service providers under data protection agreements.

Acknowledgement of Privacy Rights

By using our Services, you acknowledge that you have been provided with, and have had the opportunity to review, our Privacy Policy. You understand your privacy rights, including the right to access, amend, and restrict uses of your personal health information, and the right to file a complaint with applicable regulatory authorities if you believe your privacy rights have been violated.

Protection of Personal Health Information

All data transmitted through our platform is encrypted using industry-standard protocols over HTTPS. Our patient portal and intake forms operate over secure connections exclusively. Access to personal health information is restricted to authorized personnel on a need-to-know basis, and all staff undergo privacy training and are bound by confidentiality obligations.

Billing, Refunds & Cancellation

Consultation Fees

By submitting your health intake and payment information, you authorize DissolvdRX to charge your payment method for the applicable consultation and/or subscription fee. All fees are disclosed clearly before you complete your purchase.

Subscription Plans

If you enroll in a recurring subscription, your payment method will be charged automatically at the start of each billing cycle. You may cancel your subscription at any time through your patient portal or by contacting support at hello@dissolvdrx.com. Cancellations take effect at the end of the current billing period.

Refund Policy — All Sales Final

All sales are final. Because DissolvdRX dispenses prescription medications, we are unable to accept returns or issue refunds for any medication that has been dispensed and shipped. Federal and state pharmacy regulations prohibit the return or reuse of prescription drugs once they have left a licensed pharmacy, regardless of whether the package has been opened.

The only exception to this policy is as follows: if a licensed provider determines that you are not a candidate for treatment following your intake review, and no prescription is issued, you will receive a full refund of your consultation fee. No refund will be issued once a prescription has been approved and dispensed.

Limitation of Liability & Disclaimers

Disclaimer of Warranties

The Services are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. DissolvdRX does not warrant that the Services will be uninterrupted, error-free, or free of viruses or other harmful components.

Limitation of Liability

To the fullest extent permitted by applicable law, DissolvdRX LLC, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services. In no event shall our total liability to you exceed the amount paid by you to DissolvdRX in the twelve (12) months preceding the claim.

Indemnification

You agree to indemnify and hold harmless DissolvdRX LLC and its officers, directors, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your use of the Services, your violation of these Terms, or your violation of any rights of another.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Sheridan County, Wyoming.
